No-one likes legalese, especially not a speech writer, but we have to have a few rules in place in order for us to work together.
Here are the terms and conditions of your Freelance Speech in the simplest language possible. There’s nothing in here to catch you out and I do suggest you have a quick check through before you return the questionnairre.
By asking me to write your speech, you, the buyer are hiring me, Simon Hembra, trading as Freelance Speeches, of 2 Sydenham Place, Sydenham Road, Bristol, BS6 5SB to write you a speech for the Listed Price (as quoted on your estimate). This contract is completed when you fill-in and return my questionnaire, or otherwise accept my estimate. I will confirm your acceptance in writing. However I will not issue an invoice, or ask for payment until you have received a first draft and express your desire to continue to a final draft. In addition you are entitled to a full refund if you are unhappy with your speech, at any time up until you sign off on the final draft.
Of course it’s a little more complicated, but we’ll get to that.
What do both parties agree to do?
As my customer, you can enter this contract on behalf of yourself, your company or your organisation. You agree to provide me with everything I need to complete the project including text, images and other information as and when I need it, and in the format I ask for. You also agree to review my work, provide feedback and sign-off on work in a timely manner or to any deadlines that we agree together. You also agree to stick to the payment schedule set out at the end of this contract.
I have the experience and ability to perform the services you need and will carry them out in a professional and timely manner. Along the way I will endeavor to meet all the deadlines set but I can’t be responsible for a missed deadline if you have been late in supplying materials or have not approved or signed off my work on-time at any stage. On top of this I will also maintain the confidentiality of any information that you give me.
Getting down to the nitty gritty
The speech you get depends on what you put in. The more stories, personal jokes and memories you can give me the better your final product.
Changes and revisions
The price quoted allows for re-drafts until you’re completely happy. This is within reason however, and I cannot edit your speech indefinitely. Further to this I would note that re-drafts are limited to editing the work already written and not adding further material as you think of it. (although I will consider adding material during a re-draft where reasonable).
Don’t sue me!
I will make every effort to ensure your speech is right for you and will be well received by your audience. However it is your responsibility, as the buyer, to ensure the final speech is acceptable and appropriate. I can not take any responsibility for any offence, either to yourself or others, or any damages, financial or otherwise that may result from the speech I provide.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
You guarantee me that any stories, jokes or other elements you provide me for inclusion in your speech are either of your own creation or used with permission.
Upon agreement of the finished draft and receipt of payment I give you limited copyright of the speech. You can use it for its intended purpose, that is for public oral delivery at the wedding and events linked to it, and reproduce it in printed form, for private use free of charge. However you may not sell or otherwise profit from the content of the speech without my express written permission.
In return, I promise to keep your confidentiality and not reuse or republish the speech in any form without your explicit written consent.
Your Personal Data
I will ask you for your personal details such as your name, address and contact detail, which will be kept on file for future reference (incase you need any further speeches in the future or you refer a new customer to me entitling them to a discount.)
I will also ask for some personal stories about you or other people in order to create your speech which will be kept only until you have signed off on your final speech and the speech has been delivered.
I will keep copies of your final speech for my own reference and training, unless you ask me to agree otherwise.
Your data will NEVER be sold out, or provided, to other people unless I have your explicit written authority to do so.
I’m sure you understand how important it that you pay the invoices I send out to you promptly and, at the latest, within 14 days of receipt. Freelance Speeches is a small business and relies on quick payments to stay afloat. I will invoice you only when you have received your first draft and have confirmed that you wish to proceed.
The No-Risk Guarantee
I will write you a first draft for free, and invoice you only when you have confirmed that the first draft is acceptable and you wish to proceed.
However, if for any reason you’re still not completely satisfied, and I can’t make it right, I will refund in full any money you have paid to me to date, and the speech will be yours for free.
I only ask that you provide me with feedback as to what went wrong so I can make sure I do better job next time round.
The small print
Just like a parking ticket, you cannot transfer this contract to anyone else without my permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.
Also, these terms are subject to change, and you are recommended to keep a copy of the terms on the date that you accept your estimate.
Although the language is simple, the intentions are serious and this contract is a legal document under exclusive jurisdiction of the English courts.
